TowME Namibia Terms and Conditions

Welcome to TowME Namibia. These Terms and Conditions govern your use of the TowME Namibia mobile application, website, and related services. By accessing or using our Platform, you agree to comply with and be bound by these Terms.

Roadside assistance terms for users, operators, and platform visitors.

Introduction

Agreement to use the TowME platform

These Terms apply to the TowME Namibia mobile application, website, and related services. They explain the relationship between users, independent service providers, operators, visitors, and TowME Namibia as the platform provider.

1. About TowME Namibia

TowME Namibia is a digital platform that connects users with roadside assistance providers, towing operators, and related service providers.

We do not directly provide towing or roadside services unless explicitly stated. We act as an intermediary between users and independent service providers.

2. Eligibility

  • Be at least 18 years old
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information during registration

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account details.
  • All activity under your account is your responsibility.
  • TowME Namibia reserves the right to suspend or terminate accounts for misuse or fraudulent activity.

4. Services Provided

TowME Namibia enables users to request roadside assistance, track service providers, communicate with operators and store service history. Service availability, response times and third-party service quality are not guaranteed.

5. Service Providers

All towing operators and roadside assistance providers are independent contractors and are responsible for their own licensing, insurance and legal compliance.

6. Payments, Fees and Subscription Plans

Users agree to pay all applicable fees. Pricing may vary by location, service and subscription plan. Payments may be processed through TowME or directly with providers. TowME may charge subscription, facilitation or administration fees. Payments are non-refundable unless otherwise stated. Certain benefits are only available to active subscribers.

7. Subscription Terms, Renewal and Cancellation

Subscription term
12 months minimum.
Automatic renewal
Renews automatically for further 12-month periods unless cancelled.
Notice of non-renewal
30 days written notice before expiry.
Upgrades
Allowed anytime and may be charged pro-rata.
Downgrades
Effective only at renewal.
Early cancellation
Customer remains liable for outstanding fees for the remainder of the contractual term. No refunds unless required by law.

8. Subscription Benefits and Fair Use Policy

Unlimited roadside emergency call-outs are subject to fair use.

Unlimited emergency towing applies up to 50 km per qualifying breakdown or accident. Additional kilometres are charged at prevailing rates.

Fuel delivery includes free delivery service up to 3 times per 12-month period. Fuel delivery is limited to a maximum of 25 litres per call-out. The delivery service is included; the cost of the fuel supplied is charged separately. TowME may investigate or limit excessive, abusive or fraudulent use including repeated towing for the same unresolved fault, workshop transfers or non-emergency transport.

9. Additional Subscription Benefits and Conditions

Accidental Breakdown and Accident Assistance

TowME Namibia provides roadside assistance for qualifying mechanical breakdowns and motor vehicle accidents occurring during the active subscription period. Assistance is limited to genuine roadside emergencies and remains subject to the applicable subscription benefits, fair use policy, and these Terms and Conditions.

Annual Out-of-Town Emergency Tow

Each eligible subscription includes one (1) out-of-town emergency towing service per twelve (12) month subscription period.

  • Applies only to genuine roadside emergencies resulting from a mechanical breakdown or motor vehicle accident.
  • Must be authorised by TowME Namibia before the service is provided.
  • Is limited to one (1) qualifying incident per annual subscription period.
  • Is subject to the maximum towing distance and any additional limits applicable to the subscriber's selected plan.
  • Any distance exceeding the included towing benefit will be charged at TowME Namibia's prevailing rates.
  • Unused out-of-town towing benefits do not accumulate or carry over to any subsequent subscription period.

Out-of-Town Emergency Accommodation Benefit

Eligible subscribers may qualify for up to two (2) nights of emergency accommodation per qualifying roadside incident, limited to a maximum of two (2) accommodation claims per twelve (12) month subscription period, for the subscriber and up to three (3) accompanying family members (maximum four (4) persons).

This benefit is available only where:

  • The vehicle has suffered a qualifying mechanical breakdown or has been involved in a motor vehicle accident.
  • The incident occurs outside the subscriber's normal town or city of residence.
  • The vehicle cannot be safely driven or repaired on the same day.
  • TowME Namibia determines that overnight accommodation is reasonably necessary.

All accommodation is subject to prior authorisation and approval by TowME Namibia.

TowME Namibia reserves the sole discretion to determine whether the benefit applies, the accommodation establishment to be used, the number of nights approved up to the maximum benefit, and the maximum accommodation rate payable.

TowME Namibia will not reimburse accommodation arranged without prior approval and will not be liable for any costs exceeding the approved accommodation rate. Meals, beverages, room service, incidental expenses, transport, entertainment, deposits, damages, or any additional charges are excluded and remain the responsibility of the subscriber.

10. User Responsibilities

Provide accurate information, use the Platform lawfully and treat service providers respectfully.

11. Limitation of Liability

TowME is not liable for damages caused by service providers, delays, missed services, vehicle damage, property loss or indirect damages.

12. Insurance and Claims

Claims must be directed to the service provider or insurer. TowME may facilitate communication but is not responsible for claim outcomes.

13. Data and Privacy

Personal data is processed in accordance with the Privacy Policy.

14. Intellectual Property

All branding, software, source code, designs, documentation and related intellectual property belong to TowME Namibia. Unauthorised copying, cloning, reverse engineering or commercial use is prohibited and may result in legal action.

15. Platform Availability

Availability is not guaranteed and may be affected by maintenance or technical issues.

16. Termination

TowME may suspend or terminate accounts for violations of these Terms.

17. Changes to Terms

TowME may amend these Terms at any time. Continued use constitutes acceptance.

18. Governing Law

These Terms are governed by the laws of the Republic of Namibia.

19. Dispute Resolution

Disputes should first be resolved amicably, failing which they will be referred to the competent courts of Namibia.
